The Tennessee Supreme Court filed an
important opinion on February 13, Walker v. Sunrise Pontiac-GMC Truck, Inc.
It holds that class actions cannot be filed under the Tennessee Consumer
Protection Act. Why
not? Because T.C.A. §47-18-109(a)(1) restricts the consumer to bringing an
action for damages “individually.” I shall cover Chief ustice Barker’s
opinion in detail this fall.
